About

Jason focuses his practice on land use and zoning, with a particular emphasis on the towns of Cary and Apex in Wake County, North Carolina. Jason has represented land owners and developers on a wide range of development projects, and is engaged in development projects from the rezoning stage through the issuance of building permits and enforcement issues that arise during the life of a development.

Jason’s practice includes legislative, quasi-judicial and administrative approvals. Prior to founding Morningstar, Jason was a partner in the Raleigh office of K&L Gates.

A proud father of two girls and devoted husband, when Jason is not working he enjoys spending time with his family and NC State Wolfpack sports.

Education/Admissions

Jason is a 1999 graduate of North Carolina State University, where he earned a Bachelor of Arts in Political Science. Jason is a 2002 graduate of Wake Forest University Law School, where he served on the Intellectual Property Law Journal and was a Cooke Scholar.

Land Use entitlements

  • Lead attorney representing national office developer in the entitlement of more than one million square feet of office in the Town of Cary.
  • Lead attorney representing numerous clients through the Town of Cary quasi-judicial site plan approval process, including site plans for office, retail, institutional, religious and residential uses.
  • Lead attorney representing numerous regional and national home builders through the Town of Cary rezoning process.
  • Lead attorney representing numerous clients with entitlements and permitting issues in the Town of Cary.
  • Lead attorney representing numerous national home builders through the Town of Apex rezoning process.
  • Lead attorney representing regional developer of affordable housing communities, including developments in the towns of Wendell, Knightdale and Edenton.
  • Lead attorney in representing local developer with procuring rezoning approval from the City of Raleigh, N.C. for a master plan development including up to 325 multifamily residential units and 12,000 square feet of retail space.
  • Lead attorney in representing national developer with procuring special use permit approval from the Town of Morrisville, N.C. for 600,000 square feet retail development anchored by two big box uses.
  • Lead attorney in procuring special use permit approval for the operation of a heliport in the City of Raleigh, N.C.
  • Represented national and regional developers in zoning and permitting matters in the City of Raleigh, Wake County, N.C., and several other Triangle municipalities.
  • Represented national single-family residential developer with the acquisition of more than 2,000 acres for development in the Triangle.
  • Represented local developer in the leasing of office and retail space at mixed use redevelopment project in the City of Raleigh, N.C.

Litigation

  • Lead attorney on a multimillion dollar litigation matter on behalf of a property owner against a local government
  • Lead attorney in a ten day jury trial on behalf of an institutional client, which resulted in a jury verdict in the client’s favor and, ultimately, an affirmation by the North Carolina Court of Appeals
  • Lead attorney handling numerous mechanic’s lien lawsuits on behalf of a national developer
  • Lead attorney representing a regional developer client which resulted in the successful settlement of more than 80 lien claims, allowing the development to be recapitalized
  • Lead attorney in the appeal of numerous quasi-judicial decisions to Superior Court
