Shannon R. Joseph


Shannon Joseph is a business litigation attorney and trial lawyer who joined Morningstar in 2014 after serving as a state Superior Court Judge and a North Carolina Administrative Law Judge.

Since her return to private practice, she has been recognized as a Super Lawyer, a member of Business North Carolina’s Legal Elite, and has become a member of the American Arbitration Association’s Panel of Arbitrators for Commercial and Employment matters.

With over 20 years’ experience from a career in private practice and judicial service, Shannon now advises business and individual clients with every aspect of dispute resolution and management – from Early Dispute Resolution, to trial and arbitration representation and consultation, through appeal.

Shannon regularly assists clients with Early Dispute Resolution (EDR). She helps clients effectively evaluate their strengths and risks to resolve disputes early, often before lawsuits are filed. Shannon also advises business clients on how to implement and manage their own internal EDR program. Clients often consult Shannon for advice on how to better conduct their own negotiations. In addition, Shannon is a DRC Certified Superior Court Mediator.

Shannon is an accomplished and experienced business litigator, whose work includes trying cases to jury verdict and arguing complex motions. Before serving as an Administrative Law Judge and a Superior Court Judge, she was in private practice for more than a decade with a large regional law firm where she focused on matters involving commercial disputes and business law, including business torts, contracts, unfair trade and anti-competition, intellectual property, trade secrets, products liability, and employment. She has years of experience litigating multi-party cases, and with directing and managing e-discovery to control costs and strategically pursue case-specific goals.

In addition to representing clients in trial, Shannon serves as a trial consultant for both lawyers and clients when a case must be tried, particularly for jury trials. She has enjoyed a vibrant state court appellate practice, including multiple appearances before the North Carolina Court of Appeals and North Carolina Supreme Court. Shannon also advises clients and lawyers on issue preservation so that an adverse result may be successfully appealed or challenged in post-trial motions.

Shannon’s considerable experience as a lawyer is immeasurably informed by her judicial service. As a Superior Court Judge, Shannon presided over civil and criminal court in over thirty counties, including in more than one hundred jury trials. She decided hundreds of civil motions in every manner of case and was designated by the North Carolina Chief Justice to preside over multiple “exceptional” cases, including complex commercial matters.

She was named to the Pattern Jury Instruction Committee, on which she worked with five other judges to revise and author civil jury instructions in connection with new legislation and appellate precedent.

Shannon also assisted on the local level in the Tenth Judicial District with modifications to the Local Rules for Civil Superior Court. During her tenure as an Administrative Law Judge, Shannon adjudicated contested cases between private parties and state agencies, including disputes related to licensing, public employment, and tax issues. Shannon brings all of this experience and perspective to the table for every client to find the best path forward.

She is a graduate of the Wake Forest University School of Law, where she was the Managing Editor of the Wake Forest Law Review and was made a member of the Order of Barristers.
